Civil Disputes and Litigation Funding

At E. Rex Makin & Co we are clear and transparent in our dealings with our clients; we do not have gimmicks or hidden costs and expenses.

We will discuss all funding options with you at the outset of your case to select the most appropriate for you.

Depending on your issue we may offer you the following funding options:

Conditional Fee Agreement (commonly known as No Win No Fee)

  • A Conditional Fee Agreement has no financial risk to you
  • If you lose your case you will not have to pay for solicitors fees, we take this risk on your behalf
  • If we win your case we take a percentage of the damages (up to 25%)

Legal Expense Insurance

We will investigate the possibility of funding your case through a legal expense insurance policy.  Your building, contents, car or other financial insurance policy this may cover all or part of your costs.  The firm will take you through this option if it is available to you.

Your insurers may allocate a solicitors firm to you from their own panel solicitors.  A recent decision from the European Court of Justice makes it clear that you can instruct a solicitor of your own choice.

Membership Organisations

Some union and membership organisations offer legal cover within the membership benefits. If you are a member of such an organisation you should inform your solicitor who will be able to give you assistance and advise on the options available.

Private Funding

We understand that the thought of the costs involved in pursuing this type of legal matter may be troubling you. We are flexible in our approach to payment arrangements and are happy to discuss suitable payment arrangements for you.

Fixed Fee

On some matters we have fixed fee options available. The firm will assess your situation and provide you with a fixed fee to assist with your case. This arrangement gives you a level of cost certainty; in some circumstances we are able to do this in stages of your case giving you more flexibility.

Agreed Hourly Rate

The firm will assess your case and provide a fully flexible option on an hour-by-hour basis. You will be given information about the likely overall cost of your matter and you will be updated as to these costs as the matter progresses.

Making a Payment

You may pay a bill or place money on account for our services using:

  • A credit card or debit card (standard bank charges apply)
  • Bank transfer
  • Cash (limit applies per transaction)
  • Cheque

Payments made by credit and debit card are subject to clearance by your card provider and will normally take three to five working days to credit E. Rex Makin & Co client account. If your payment is required for immediate use please call us to discuss another method of payment. Outgoing payments will not be made using your credit/debit card payment until we are in receipt of cleared funds.

Refunds

Any refunds due on a matter where payment has been made wholly by credit/debit card will only be refunded by using the card details previously supplied.

Requested refunds will be dealt with under our complaints procedure. Refunds will not be made where the payment has already been used to meet third party expenses.

If you are not entirely satisfied with our service, we agree to refund you in accordance with our terms and conditions and code of conduct as regulated by the Solicitors Regulation Authority.

Payments by card can only be accepted with authorisation from the cardholder. If you are not the cardholder please call the Accounts Team for assistance on 0151 709 4491.

Your Information

During the payment process you will be required to enter the credit or debit card security code and you may be asked for further card authentication by your credit or debit card provider.

Please note, Personal Data such as your name, address and contact details may be required. Any Personal Data will be used in accordance with Data Protection requirements.

Some personal information will be received by us for reference purposes. We will not keep this information for longer than is necessary for the purpose for which it is collected.

The Costs Of A Group Claim

It is likely that your action will cost you nothing. There are three possible ways to fund a case without cost:

  • We can represent you on the basis of a “No Win, No Fee” arrangement
  • Your building, contents or car insurance policy may have built-in legal expense insurance
  • Public funding may be available if you claim as part of a group of individuals who have been injured
